City Utility Suit Challenge Cited as Lacking Elector Consent
Darnell argues mayor and council had no authority to file suit to condemn the utility under a charter requiring elector consent for acquisitions and bond issues. He notes a 1943 election failed to approve such moves and contends state law governs process and that improvements during litigation could violate due process.

City to condemn utility. South Tucson object
Darnell cites South Tucson position, noting it has not consented to Tucson condemning the utility. South Tucson, a town of about 4,000, had 304 electric and 198 gas customers on Jan 1, 1944, and 405 electric and 294 gas customers on Jan 1, 1946. The city argues the law allows acquisitions and denies a claim of greater public use, with the case drawing state officials’ interest as a major public ownership effort. An informal agreement with the Arizona Power Authority ties the outcome to possible steam plant transfer.
