Baca Float Case Decision Reversed by Arizona Supreme Court

The Arizona Supreme Court ruled a former Santa Cruz County senator used 5997 shares of Baca Float Ranch stock as loan security but did not sell them, reversing a lower court. The decision favored former Senate President Hubert Merryweather, who argued the stock backed a $200,000 loan to T. Pendleton. Pendleton claimed he planned to buy the stock and grant Merryweather a one year repurchase option. The ruling notes the trial court erred in ignoring an advisory jury verdict, but held the agreement likely was a security arrangement, not a sale.
