Supreme Court Allows Agency Shop in US Labor Contracts
The Supreme Court ruled unanimously that the agency shop is permissible under federal law but not in states that ban union shop. One decision upheld agency shop under Taft-Hartley in Indiana, the other barred it under a Florida anti union shop law. The court left undecided if Florida courts or the NLRB enforce state bans, to be decided next term. Justice White wrote the opinions. Justice Goldberg did not participate.
