Court Concessions For Realtors Move In Arizona
The Arizona Association of Realtors will meet Monday in Phoenix to decide action after the state supreme court allowed brokers to handle preliminary sales documents without practicing law. The court refused to review a 1961 ruling that real estate men were practicing law by drafting legal documents. The association seeks a constitutional amendment to let brokers draft and complete instruments for preliminary purchase agreements, earnest money receipts, deeds, mortgages, leases, and related papers. Attorney J Mercer Johnson said the ruling met the Realtors request for a new hearing. The court noted brokers act as agents for buyers or sellers, justifying drafting employment agreements.
