Arizona Corporation Commission Chairman A. P. Buzard warns the Supreme Court decision removing trash and garbage haulers from regulatory jurisdiction may cause serious implications and revenue loss for the state. Arizona Supreme Court Invalidates Licensing Law for Nurseries
The Arizona Supreme Court ruled the 1959 statute requiring nursery licenses unconstitutional because it lacks a hearing process when a license is denied or revoked. Mrs. Josephine Bennett, who ran Bennett's Nursery and Play School in Tucson, challenged the law after her license was refused and a hearing was denied. Her appeal led to the court decision, with the option for the Legislature to re-enact a licensing statute including hearings.
