In a Westminister court hearing Mr Sergeant Wilde sought delivery of deeds and papers from the late Mr Day's estate for administrator pendente lite Mr Simpson pending an undertaking to cover costs and 3000 pounds lodged for mortgage investment The case centers on codicils to the testator's will disputed as to mental soundness and a socl esiastical proceeding allows limited administration The court ordered the attorney to provide a costs bill within a month money and papers lodged with the prothonotary with indemnity and undertaking before delivery to Mr Simpson The day also covered motions on various matters including relief for a destitute family and a separate collision case against Edward Payne master of the Yarrow steam vessel over tar barrels on the Thames The collision caused damage to a tug and a brig with Yeates the waterman blaming Payne while courts dismissed liability citing wind and other uncontrollable factors
