Lincoln County Bonds Official Opinion on Railroading Case
The Lincoln county court had power under the 1857 act to subscribe to the St Louis and Keokuk railroad and issue bonds. The court’s orders and agent actions followed legal forms, bonds were sold for value, and holders are entitled to payment. the constitutional provision barring such subscriptions after 1865 does not apply to preexisting charters, and Lincoln county must pay the bonds as due to protect bona fide holders.
