The Timbstone City Council debated a petition from heavy taxpayers seeking a grant to the cemetery committee to maintain the city plat in the cemetery. The judge ruled the act applies to Arizona but the indictments, including those of Jesus Perez and Mathias Galas, lacked clear offense descriptions and were set aside. Bail was set for all pending next November's jury. other defendants faced similar outcomes.
