Decided Right by the Supreme Court on Water Rights

The Supreme Court of Arizona affirms a county court ruling in a water dispute between Contention Consolidated Mining Co. and defendants over San Pedro river rights. It holds riparian rights do not apply where prior appropriation exists, citing federal acts of 1866 and 1870, and explains that the plaintiffs’ claimed six by three foot canal is not required to be precisely upheld. The court affirmed the injunction preventing interference with the plaintiffs’ diverted water quantity.
