Supreme Court Rules Landlord Holds Airspace Rights Over Property
The Supreme Court, in a 5 to 2 ruling, held that landowners own the airspace above their property as far as its use and enjoyment requires. Repeated low flying aircraft trespass may warrant damages. The case stemmed from North Carolina farmers Thomas and Mrs. Lee Bausby whose chickens were frightened by army bombers, driving business losses and housing distress.
