Old Cherokee case again before court
Washington May 2 After a four year absence the famous Cherokee Indian suit returned to the United States Supreme Court. Attorneys for Head Chief Join McIntosh Second Captain Jim Mildehr and Sam Boney urged the court of claims be required to obey the Supreme Court mandate in reviewing the cage four years ago. They contended the court of claims used a per stripes basis rather than per capita distributing the funds. The lawyers claimed the Supreme Court directed the interior secretary to prepare the roll of eligible persons at great expense, and that the court of claims’ method violated the high court decree.
