Oklahoma City February 14 Attorneys Stuart Cruce and Gilbert representing T C Finkes and others filed a supplemental petition in the supreme court asking that Adjutant General Canton be cited for contempt over the January 6 removal of Delaware county records from New Jay to Old Jay The court will decide tomorrow if the writ shall issue The governor had proclaimed the Jay townsite acreage and ordered the records moved The adjutant general moved the records but a supreme court restraining order arrived after the transfer Several dozen named Delaware county citizens claim to act as Canton’s representatives and threaten county officers if records are removed The petition flags that Canton preserved possession and refused to return the records despite the court order If the court issues the writ the method of trial is debated and may require certification to an inferior court if a jury is demanded Governor Cruce said he would support the adjutant general and would grant pardons as needed
