Oklahoma Court Upholds Billups Law Provisions

Guthrie Okla Nov 24 The Supreme Court in an opinion by Chief Justice Williams sustained the constitutionality of the enforcement provisions of the Billups law and held the claimant in a search and seizure case is entitled to a jury trial The court overruled the argument that the act contains more than one subject and said cognate subjects do not violate the provision The opinion notes conditions in Oklahoma when the law was formed and says they did not bar additional legislation The notice issue in search and seizure cases was resolved by warrants or posted notices as sufficient The ruling implies jury trials were intended and rejects implied procedural limits The case arose from Oklahoma City where County Judge Sam Hooker refused warrants on grounds of unconstitutionality and Enforcement Attorney Fred S Caldwell opposed the ruling
