Supreme Court Reverses Usury Claim in Oregon Mortgage Case

In a divided ruling, the Idaho Supreme Court reverses a Latah county district court decision. The majority holds a third party cannot plead usury in a mortgage contract they agreed to pay off, as in Ellen T. Anderson et al v Oregon Mortgage Co. Justice Sullivan writes for the majority, joined by Justice Stockslager. The decision emphasizes usury is a personal defense and applies only against parties to the contract, rejecting the plaintiffs’ theory that they may cancel the mortgage after agreeing to pay it.
