John L. Lewis and William Green recessed their high level talks until 4 p.m. after a two and a half hour session with no agreement. The leaders hinted at possible changes to union structure balancing C I O and A F L plans amid rival union amalgamation and craft versus plant wide organizing.
In district court this morning a damage suit by D. R. Evans of Malad against Bannock county and Drs. D. C. Ray and W. F. Howard was nonsuited for insufficient evidence to warrant a jury trial. Judge J. L. Downing presided. a jury was discharged. Evans claimed permanent injuries from an alcohol injection during a 1935 hospital episode.
A joint filing by the Montana railroad and public utilities commission to the Interstate Commerce Commission objects to a 15 per cent freight rate increase. The protest argues Montanans cannot bear higher rail costs, claims the rise would ruin rail transportation, accuses railroads of lacking economy, and says current rates approach the ceiling of reasonableness.
The American Legion post in Pocatello will hold a meeting tonight at the Memorial building with a program and refreshments. Idaho weather shows southern sections cloudy and northern areas partly cloudy with little temperature change tonight and Friday.
R. E. Titus and Reverend Paul de Mortimore were welcomed as members of the Pocatello Rotary club at noon today at the Bannock hotel. Past President James R. Young gave the welcome.
Cavalry Troop B 116 will drill at 7 30 p m at the armory marking the first drill in two weeks after Thanksgiving. Captain Percy L West says Major H C Minuth Idaho National Guard instructor will attend and urges all enlisted men to be present. Promotions from private to private first class will occur next week based on attendance ability and appearance.
Fred Wilson faced a month old accident leaving an arm partly paralyzed. He sought medical help at a local doctor in Kellogg Idaho as winter weather set in December.
Dan W. Greenburg director of the Wyoming planning board said Wyoming would fight to the death against a plan to divert water from Yellowstone National Park. He urged a congressional investigation of motives and warned the scheme could reduce the park’s value and appeal. Greenburg favors using Idaho storage in the Snake River basin to meet irrigation needs without harming Yellowstone.
Robert Gunter eight, son of Mr and Mrs Rufus Gunter of Arimo, remains unconscious at General hospital after a Thursday collision with a car driven by Merlin P Whittle of Preston. He is treated for a fractured leg and brain concussion. Hospital reports no change in condition.
A Minneapolis coroner’s jury probes the death of AFL leader Patrick J. Corcoran as witnesses allege inter union violence fueled by gunmen and gangsters tied to AFL officials. Harold Bean, a carpenter’s union leader, testified that such forces aimed to smash the federation.
Chinese dispatches from Hangchow report over 1,000 civilians killed or wounded in a Japanese air raid on Hsiaoshan near Hangchow. Five hundred bodies were found in ruins. 1,100 houses destroyed leaving many homeless. First attack in a month, Chinese planes raided Japanese positions at Shanghai. one bomb near the former anchorate of the Japanese flagship Idzimo caused no damage.
Ogden post office workers resumed bicycle mail delivery after 35 years of motorized or other transport. A Porter era order trimmed bicycles to three for sparsely settled areas. Carriers praised the shift and rode to the post office on buses before resuming routes.
Weather brief notes unsettled conditions with colder air in the south portion tonight and again Friday.

Louisville report says Santa Claus nicknamed Carol Nicholas Breit was struck by a car while crossing the street near a store where he had worked. He suffered a broken leg and is sidelined as the holiday season begins. A replacement Santa is being prepared.

District Judge Koelsch orders state auditor to issue a $275 salary warrant to P C O Malley of Pocatello or show cause by December 11. O Malley, former manager of the state insurance fund, alleges he served under a temporary 1937 appointment and was unpaid for the final month and three days. Calvin Wright succeeded him after Governor Clark dismissed him June 1937.
The Chicago Burlington and Quincy asks the Interstate Commerce Commission to abandon a 20 mile branch from Koyle Iowa to Dainsville Missouri citing the only industry on the line is a mouse trap factory. The railroad says truckers already provide adequate service to the company.
The Interstate Commerce Commission reports a drop in railway employment. Class one railways employed 1,133,003 workers in September versus 1,162,764 in August. Employer income totaled 169,584,515 dollars, down from 175,324,948 dollars the prior month.
Hollywood report says Fred Allen spent three days filming a barber shop scene for Sally Irene and Mary. Director William Seiter rejected the first two takes, but the third retake met his approval, though Allen quipped the haircut wasn’t exactly what he ordered.
The House leadership gains momentum as 218th member Mansfield D vex signs a petition to force a mid December vote on the wage hour bill. A roll call stalls tabled motion after Fish demanded an inquiry into statements by Dies and Robertson.
Boise December 24 Idaho three man pardon board to hear Douglas Van Viack's request for commutation of his death sentence a week before the scheduled execution. His attorney Robert Allshie Jr of Boise appeals for compassion and understanding noting a wounded mind and urging full presentation to the board. Secretary of State Ira Masters cites a letter from Lyda Homer Longhurst warning that a life term could invite future crimes in a triple slaying case.
Ash bourne Orange the 38th International Livestock exposition grand champion steer sold at auction for 2.35 dollars per pound to Wilson and Co for the Palmer House in Chicago. Oklahoma A and M exhibited the champion and expected about 2620 dollars from the sale based on a 1115 pound weight. The record high price was 8.25 per pound for Lucky Strike in 1929.
Soda Springs reports the town geyser erupted twice while workers drill a nearby well for a natatorium project. Initial burst sent water 20 to 30 feet high, later rupture reached 70 feet before being controlled with canvas-wrapped equipment.
