Montana climate case set for trial on June 12
The Montana youth plaintiffs in Held v. Montana claim the fossil fuel based energy system violates their constitutional right to a clean and healthful environment. They seek to rule MEPA climate change exemption unconstitutional and demand a remedial plan based on scientific recommendations. The case proceeds to trial June 12 in Lewis and Clark County District Court before Judge Kathy Seeley after pretrial debates on summary judgment. The defense sought stays and appeals, but gatekeeping moves have been denied.
