Compromise On Cyprus Seems Likely

Counties Not Liable Judge Upsets State Institutions Levy

Dist Judge R J Nelson ruled it unconstitutional for the state to charge counties a share of the cost of keeping patients in state institutions. He struck down up to 53 percent of per diem costs assessed to counties, calling the law unconstitutional and severable from the rest of House Bill 117. Cascade County had sued with backing of others, warning potential county costs up to 250000 dollars yearly. The ruling cites four constitutional violations and notes possible appeal by the state.

Airliner Constellation Wreck Found Near Sierra Peak

Air searchers located the Paradise Airlines Constellation wreckage on an 8700 foot Sierra Nevada ridge after it vanished Sunday on a San Jose to Lake Tahoe flight. Eighty five people died amid heavy snow as crews prepared to recover bodies with FAA and CAB officials en route.

Polish Defector Fed U S Intelligence Since 1958

Polish defector Michal Goleniewski, once a KGB operative, began feeding U S intelligence in 1958 after arriving in 1961 with a new name. Basin mine owner killed in dynamite blast near Basin

Kenneth Curtiss about 65 Basin mine owner and operator died Monday after noon when dynamite exploded in the drift of a lease he operated five miles northeast of Basin Jefferson County Sheriff George Paradis said Curtiss had drilled and packed at least 25 holes when the unexplained explosion occurred at about 3 p.m Norbert Stauner Curtiss partner on top running a hoist investigated and found Curtiss body Stauner called for help the blast occurred at a base in Big Limber Gulch the shaft was about 50 feet deep and Curtiss had drifted in 60 to 70 feet Survivors include his wife in Basin and daughters Mrs Milton Gilmer of Boulder and Mrs Emmett McCauley of Boulder Valley Remains are in White's Funeral Home in Butte.

Ruby murder trial jury short two after outbursts

Jack Ruby’s murder trial nears 11 jurors as two more seats wait. Defense lawyer Melvin Belli is fined for contempt after a recess clash over pamphlets claiming psycho motor epilepsy triggered Ruby’s blackout state. Trial resumes Tuesday with 149 jurors questioned.

City panel blocks petition to close streets on Butte East Side

The Butte City Council voted 10 to 6 to disallow Anaconda Co. petition to close parts of East Broad Way area from Gaylord to Warren streets, citing public interest concerns. A 29-signature petition argued closures would harm residents amid Berkeley Pit expansion noise and pollution. Aldermen Sorich urged progress with caution as residents voiced opposition in a two hour meeting.

Prison inmate seeks state payout for bodily damages

Alvin Wuest, an inmate at the Montana State Prison in Deer Lodge, claims civil rights violations over prison conditions. In Butte federal court he seeks payment for physical and bodily damages and has been granted leave to proceed in forma pauperis. The action names the state of Montana and related officials.

Harmon to lead Montana Board of Public Institutions

Maurice A. Harmon of Washington will become director of the Montana Board of Public Institutions on May 1, replacing acting director Edward W. Nelson. Nelson will join Gov. Tim Babcock’s staff as administrative assistant. Harmon has led the Washington Bureau of Juvenile Rehabilitation since 1952. Nelson has been acting director since the board’s July 1963 organization. The announcements were made in Deer Lodge and Helena.

Babcock opens campaign headquarters in Helena

Gov Tim Babcock opened his campaign headquarters in Helena in a former doctors’ office suite with a mix of fresh paint and coffee aromas. Orvin Flare will manage the reelection bid, resigning as state advertising director to take the job, while Mary Helen Cheney serves as campaign executive secretary.

Two Children Killed in Fort Belknap Reservation Wreck

Harlem AP report says two children died and at least one other person was critically injured in a one car crash on Montana Highway 376 south of Harlem on the Fort Belknap Indian Reservation. Duane Cole and Louis Stiff-Arm were hospitalized with undetermined injuries. Investigation by Highway Patrolman Howard Gipe and the Bureau of Indian Affairs continues.

Wayne Tripp Dies Suddenly In Santa Monica

Wayne Tripp, 6, former Butte gunsmith and locksmith, died Sunday in Santa Monica California after a heart attack. He and his brother Ralph ran Tripp's Gun and Key Shop on South Main. Born January 18 1900 in Butte he was active in local gun and boating clubs and later worked for Specialty Development Corp. Survived by widow Corinne two sons Robert and Tom four brothers three in Butte one in Paradise and two sisters. Body to arrive in Butte Wednesday for services Thursday at Wayrynen Funeral Home with Rev F Leon Furrh presiding. Burial planned Mountain View Cemetery.
