Montana Supreme Court Limits Highway Condemnation Power
The Montana Supreme Court ruled that a district judge may determine the necessity of condemning land for highways, upholding a lower ruling that blocked the state from taking seven miles of land near Billings for an interstate frontage road. The decision also denied the commission’s broader authority to bypass judicial review in condemnation cases, while affirming a separate award of 32,275 to Julia Voyich and family for 17.6 acres in Park County.
