MISSOULA April 24 Military legal machinery has ground out the case of two soldiers who were sentenced almost two years ago to hang on kidnaping and morals charges and then await execution at the Army's Fort Missoula disciplinary barracks. John Phil Rowe, counsel for Privates John W. Besherse, 23, of Alabama and Keith E. List, 23, of Logansport, Ind, reported Tuesday that President Truman had refused executive clemency for the pair. They were convicted of kidnaping a Bakersfield, Calif., woman two years ago. An Army courtmartial imposed the death sentence in April, 1944, shortly after the two were captured. The court martial proceedings were reviewed and approved in July, 1944, by high Army officers and by President Truman, in accordance with military law. Besherse and List were to be hanged last August 17, but they were saved when the case was taken into a civil court.
