Supreme Court upholds state quarantine power in 1878 case
The Supreme Court ruled that states may exclude immigrants from quarantined cities until Congress acts on quarantine power. The decision in Brittania v Louisiana board of health, about landing 400 Italians in New Orleans amid yellow fever, upheld state authority. Justices Marlan and Brown dissented. The Court also affirmed the Interstate Commerce Commission v Chicago, Burlington & Quincy Railroad case on livestock rate reductions, denying the commission’s order. The term adjourned to October 13.

Bucket Shop Fight Moves Through Court Battle
Defendants in the Chicago Board of Trade bucket shop case filed their answer in federal court. The Board claims it controls about three quarters of general food prices and seeks an injunction, while the defense argues openness of information and disputes the Board’s claimed property limits. They contend they act as commission agents, not bucket shops, and label the Board itself a bucket shop with inflated floor deals.
