The case against State's Attorney Kelley ended Saturday afternoon when L. A. Melum testified he did not loan the money on the strength of the abstract. Following the testimony the court, on motion by the defense, took the case from the jury and acquitted Kelley.

The real estate described as part of the east quarter of the southeast quarter section seven lies in Beadle County and is to satisfy a 136 dollar debt plus costs under an execution issued by a circuit court in South Dakota.
