Supreme court rules on double jeopardy under state laws
Charleston May 293 The Supreme Court disposed of three cases involving questions under prohibition laws. It held Section 22 Chapter 14 Acts 1916 unconstitutional as it allowed the state to appeal in all cases, risking double jeopardy. The Bornee case, McDowell and Marshall counties involved writs of habeas corpus, and Rhodes alias Black Baby saw the writ dismissed. Kinick Marshall county not violated.
