Permit Denied For Races At Charles Town
Charleston W Va Nov 24 Denied a permit by state racing officials for a horse race meeting at Charles Town in December the Charles Town Jockey Club fri day filed suit in the Kanawha County Circuit Court to compel issuance of the license The club obtained a writ directing McLaughlin to show cause why the permit should not be granted McLaughlin said he denied the permit because of improper financing asserting that A J Boyle president of the Jockey Club could not guarantee the purses and there was no evidence of funds He added the club asked the state permit upon representations that all conditions would be met if it proved financially successful The commissioner said the race condition book did not meet his approval McLaughlin contends the state law gives him the right to prescribe rules and to require adequate security He said the only offered security was 20000 in second mortgage bonds of the club and a Charles Town bank refused them Beltzhoover argued the Racing Commissioner has no right to demand security He noted only tax security is required by law If needed the club will appeal to the State Supreme Court
