Secretary Hitchcock Sets Eight Month Residence Rule for Homesteads

Secretary Hitchcock has ruled that homesteaders must reside on their public land for eight months during the fourteen month commutation period before final proof. Decisions from South Dakota Nebraska and Oklahoma show proof of residence must be continuous from entry to final proof. Entrymen may return to continue residence to satisfy the law or risk relinquishing homestead rights.
