State Laws Will Punish Interstate Traffickers in Intoxicanta
June 19 Webb law barring interstate liquor shipments into dry states is not a criminal statute, says Attorney General McReynolds. It imposes no penalty. its aim is to enable state laws to govern intoxicants moving in commerce between states. This marks the first Justice Department reading of the Webb Act, previously struck down by Taft and Wickersham. The federal government is not required to enforce a penalty lacking a provision, leaving interstate commerce as outlawed to state action, with Supreme Court review possible.
