City manager Dale Rieth said the courts reluctance to convict on tickets issued by the fire and police departments has made the City reluctant to Issue fire code violation citations because it is Felt that nothing will come of them. Fire chief ted Deming told the Council he has been on the verge of issuing fire code violation citations on several occasions but has stopped because there is no mechanism to prosecute once they Are issued. City clerk Steve Albee said he first realized there was something wrong when the City came up $20,000 Short on the amount of Money it normally collects for traffic fines. A obviously people Are not being prosecuted a he said but added that the City of Sarasota has had the same problem and has hired its own prosecuting attorney to try and remedy the situation. He said someone in his office went to court with a Friend that had been charged with a second driving while intoxicated offence and the judge threw the Case out when he saw it was a City ticket. A everybody is a Little spooky about it a Albee said because without prosecution the people with the Power to Issue citations really have no Teeth to Back them up. Wheeler said one reason the cases Are not being prosecuted is that they Are based on City rather than state statutes but explained that he has not talked to the state attorneys office. The Council seemed amazed that the situation had been ongoing and instructed Rieth and the City attorney to try and find out what the problem is. In other fire department matters Deming told Council he would not recommend instituting a fire Cadet program using High school students because the City a insurance liability would be too High. The Cadet program was suggested several months ago to bolster the ranks of the fire department but Deming said research has showed the cadets could not be put in positions of responsibility and therefore would be of Little use. An investigation by the City attorneys office in the possibility of charging the unincorporated enclaves within the City for fire service revealed that such a practice would not be Legal. That office also nixed a proposal to get formal Mutual Aid agreements signed Between Venice and the surrounding Volunteer fire departments because of a Legal technicality which forbids such agreements.
