Indiana and Chicago Coal Co v James Neal upheld by the appellate court. Justice Roby writes that forcing drivers to open and hold airways created a danger and violated mining act provisions, yielding liability to injured drivers. The decision rejects requiring proof of knowledge of danger or assumption of risk. It also finds that minimal miscalculation in stooping does not prove contributory negligence under unlawful conditions.
