Legal Opinion on Constitutionality of County Election Delay
Hon. Adison C. Harris advises Republican State Committee that the 1903 act postponing county officer elections is unconstitutional and void. He notes the Indiana constitution requires electing clerks, auditors, recorders, treasurer, sheriff, coroner and surveyor at general elections with fixed term lengths, and that vacancies trigger next general election, implying a new primary may be needed for Treasurer and Prosecuting Attorney in 1906.
