Woman's murder conviction reversed in landmark case
The Mount Vernon appellate court overturned Donna Duncan's murder conviction but left other charges intact citing a prior ruling in People v. Pelt which held that a felony of aggravated battery of a child cannot be used to establish a murder conviction if part of the act of murder. Trambley called the ruling a technical setback though he noted evidence supported guilt on all charges. He urged continued attention to child abuse issues.
