Court grants employers new rights in bias suits
The Supreme Court expands defenses for employers facing race bias claims, allowing use of statistics to show a legitimate, non discriminatory motive. The decision reverses a lower court ruling against Furnco Construction Co. and could affect many workplace discrimination cases, including those by women. Justice Rehnquist writes that proving a neutral employment goal suffices to shift the burden, while acknowledging that a racially balanced workforce does not immunize an employer from liability for specific acts.
