Harrisburg firm seeks voiding of Enron contract in court
American Coal Co asks Saline County Court to null a seven year sales pact with Enron claiming breach after Enron’s credit rating fell amid bankruptcy last year. The firm sells several million tons from Illinois Galatia, Washington County Pennsylvania and Belmont County Ohio mines. Enron filed for Chapter 11 in December and American Coal alleges late last year Enron failed to meet minimums. Enron disputes and seeks default payments of 1.8 million. American Coal says it can sell to other buyers if the court ends the contract, noting Galatia mine yields about 7 million tons annually and Maple Creek 3 million and Powhatan No 6 about 5.5 million tons.
