Appeals court rules DNA testing not a constitutional right
The 4th U.S. Circuit Court of Appeals reversed a 1990 rape conviction case ruling, holding James Harvey did not prove a due process or civil rights violation by denying post conviction DNA testing on evidence. The panel said creating a universal federal DNA right is improper and left testing to legislation or state constitutions. Harvey seeks testing under Virginia law and may appeal.
