Court overturns one BB gun conviction in Illinois

The Illinois Supreme Court overturned one of Henry County man Joshua T. Davis's convictions for battery and armed violence after he fired a BB gun at two youths. The ruling notes the armed violence statute lacks explicit mention of BB guns, so the conviction was inappropriate. The incident occurred July 2, 1998, when 17 year old Matthew Mulder lost an eye and 15 year old Cody Junior was injured. Mulder's remarks reflect the impact. Davis, now 23, faced a minimum six year sentence for armed violence at sentencing.

Ruling Upholds Immunity, Reverses Several Cook County Convictions

The court ruled a boy injured in gym class cannot sue due to government immunity. It upheld a Cook County man's sexual assault conviction despite speedy trial concerns caused by indecision over representation. It overturned a $675,000 malpractice award against a Cook County doctor, with jury findings on dehydration and cause of death reconsidered. A concurrent 364 day sentence for battery was noted, and Barnes reversed an aggravated battery conviction tied to an armed violence verdict. Davis ordered restitution totaling $28,173 to two families.
