Illinois Court Awards $37,300 in Wreck Case Near Marion
The Illinois Court of Claims awarded $37,300 against the state for a Dec 3 1961 wreck at the Rt 37 Rt 148 intersection known as The Wall near Marion. Awards include $20,000 to Andrew J. Smith as administrator of L C Tyler estate and others. One death L C Tyler 23 and four injured including William Tyler Irene Jacobs Cheryl Johnson and John T White. White was denied due to contributory negligence. The Rock wall site has caused many previous wrecks and a 1960 intersection upgrade followed by safety measures. The court found state negligence for lack of warning signs and unsafe traffic controls. In separate notice the Illinois secretary of state revoked or suspended multiple drivers licenses for violations. a probationary permit issued to Cecil E LaBotte.
