New law could be costly for Illinois doctors
Illinois lawmakers signed legislation in May allowing damages for grief and mental suffering in wrongful death cases. Supporters say competition among insurers and existing caps will limit impact. opponents warn doctors may leave the state to dodge higher malpractice costs and premiums. Dr. Rodney Osborn of the Illinois State Medical Society argues the bill expands awards and hurts physician retention. Rep. John Fritchey says increased insurer competition, not higher damages, will curb costs, noting caps were set in 2005 at 500000 against physicians and 1000000 against hospitals.
