Illinois tightens drunk defense and limits evidence storage
Gov. George H. Ryan signed laws to curb intoxication defenses and limit forensic evidence storage. The drunk defense burden shifts to the defense if intoxication is claimed, effective Jan 1. A separate law sets a seven year retention for sexual assault and homicide evidence, with permanent storage only for death penalty cases and a Jan 6 2006 grace period. The measures, backed by Rep. Thomas L. Johnson and Sen. Carl E. Hawkinson, respond to a Quad Cities case.
