Balderston Succeeds In Landmark Land Law ruling

William Balderston of the Boise land office helped secure a sweeping decision by the general land office that miners may claim mineral status based on formation and actual mining potential. The ruling challenges prior, strict payback tests that kept many prospectors from entry. It notes common hardship, citing Montana’s Drum Summon and Idaho cases, and anticipates restoring miners rights while winding back discretionary thresholds. Forty water contracts were filed in county records, with several Carey Act patents expected later this week.
