In Warrensburg Missouri on June 26 the Carrier vs Missouri Pacific damage suit ended with an 11 to 1 verdict in favor of the plaintiff. T E Carrier a deaf mute was struck near the track by an east bound train and died minutes later. The widow sought 5000 damages claiming no whistle or bell were heard. The railroad argued the whistle and bell were rung. The trial was a hard fought legal battle.
