City Moves to Remove Fence and Replac Crossing on Poplar Street
The city adopts a tougher stance over the Delaware and Madison company's fencing on Poplar Street. If the company refuses to remove, the street commissioner will act to replank the crossing, aiming to open the street for public use. The mayor cites Supreme Court precedent allowing municipalities to open railroad rights of way with only nominal damages. The dispute centers on land ownership and the city’s authority to reclaim Center Street for public use.
