Contested Election Costs and Act 1809 Interpretations

The court analyzes costs allocation in a contested election under the act of 1809 and 1880s provisions. Petitioners argue for costs against opponents, while the court finds no clear intent to impose costs under the cited statutes and dismisses adding penalties beyond the act’s scope. The ruling notes the act’s ambiguities and suggests the remedy aligns with historic intent, potentially reversing prior proceedings or awarding reconsideration.
