Erie Company Answers Suit Over Canal Bed Dispute
Erie Company asserts no right of possession to the canal bed at Lickawaxen and contends its rival Delaware and Hudson line, plus a parallel route, violate constitutional limits on railway and canal control. It claims prior joint occupancy ended in 1899 and that a 1848 grant and 1848 Delaware and Hudson deed support its title while alleging the plaintiff's ownership and plans threaten a separate contract with the Erie and Wyoming Valley Railroad.
