Arizona Implicit Consent Law Under Review by Federal Judges
A three judge Federal court panel in Phoenix has the case under advisement on whether Arizona implied consent law is unconstitutional. Ernest Chavez's attorney George W. Oglesby argues the law aims to keep drunken driving off the road but may not do so effectively. He notes that refusing the test leads to an automatic six month license loss, unlike first offenses for those who take the breathalyzer.
