Supreme Court allows mandatory retirement for civil servants
The Supreme Court ruled 7 to 1 that civil servants may be forced to retire at a set age. Massachusetts police must retire at 50, the lowest retirement age for state police nationwide. The court found a reasonable basis under the Equal Protection Clause and reversed a lower court decision. Justice Marshall dissented deeming employment a fundamental right and calling mandatory retirement a significant deprivation.
