In Austin the carriers in the Western District of Texas equity docket filed a 25 page replication to the Texas attorney general's answer in the rate injunction case. It argues no land grant law can bar carriers from contesting unjust or confiscatory rates or FCC orders.

Paramount Laws and Land Grants to Texas Railroads

The text outlines that Texas land grants to railroad companies were granted with conditions to survey two sections, finance surveys, and build miles of track. It notes the grants were made when railroad transport was scarce and lands largely valueless, many certificates resold for little, and later foreclosures moved lands to third parties. It also argues the 1853 state law did not provide for repayment to the carriers and contradicts claims of rate divisions and state rights to reacquire properties.
