Forfeiture of Charter Sought in Texas Loan Firm Case
A petition filed in district court seeks to forfeit the charter of the Mutual Deposit and Loan Development as a Texas building and loan association and obtain a temporary injunction preventing officers from disposing of assets or records. Assistant Attorney General Allen Glark leads the suit for Banking Commissioner James Shaw and Mrs. Jane AlcCallum, secretary of state. The petition cites liabilities around 449 004 and nominal assets, alleging the Delaware corporation differs from the Mutual Deposit and Loan association chartered in Texas. Moon says the sued entity is not the same as the Texas association and notes the ruling will not affect shareholders or members of the Texas chartered body. The case centers on valuation of certain assets and the proper identity of the organization.
