Moody declines discuss Hoffman settlement in Texas suit
Austin Nov 28 Attorney General Dan Moody declined to discuss the proposed compromise offered by the Hoffman Construction Company in a suit filed by the state seeking cancelation of highway contracts, an injunction to stop $951,000 payments and $100,000 damages. The case goes to trial Monday before Judge George Galveston in Fifty third District Court. The state seeks a receiver to manage property involved in the litigation. The Hoffman offer proposes either a second application of asphalt on 600 miles of highways or a settlement with the state on terms similar to the American Road Company judgment. The company says defendants acted only in discharge of official duty and denies any improper influence by a highway commissioner. Moody had charged Auckett, then a commissioner, with involvement in the contracts.
