Fees for sheriffs on habeas corpus question

The attorney general's department ruled sheriffs can not claim witness fees in habeas corpus hearings. The comptroller and sheriff's office records show no prior allowances for such fees. The ruling aligns with a US Supreme Court view that habeas corpus is civil, not criminal, and no statute provides for witness payments in civil proceedings. The matter may go to the 31st Legislature to amend the law.
