State loses, wins on taxes in Supreme Court

Austin May 1 The state lost one tax case and won another in the Supreme Court today. The secretary of state was defeated in an important case seeking to collect additional corporation franchise taxes from the Atlanta Pipeline company. The court refused to reconsider a ruling that most of the company's operations were interstate and not subject to the franchise levy. The court declined to review another decision upholding chain store taxes on H E Butt Grocery Co of Harlingen and Southwest Texas Grocery Corp of Del Rio. The state argued the 34 stores should be treated as one unit since Butt owned a majority of stock in both corporations.
