Draft evader case featured in Houston court martial defense
In a Houston court martial proceeding Major Charles C. Cresson prepared a defense for Arthur Helm ecke of Ann Benito who awaits a writ of habeas corpus after a Browns Ville conviction for draft recertion. The case questions military jurisdiction and whether notice alone suffices to bind a civilian to service. The record references Helm ecke’s prewar garage business and a later arrest after a draft list listing his name appeared, with a five year prison term, dishonorable discharge, and forfeiture of pay.
