Austin March 18 Governor Miriam A Ferguson will not fill the highway commission vacancy caused by Gene Johnson's death until courts rule on Frank J Denison's claim. District Judge J D Moore ruled Denison not entitled to the office and the decision will be appealed to the Texas Supreme Court. The matter is now in judicial hands and cannot be acted on by the governor or senate. Denison was twice appointed but not confirmed by the senate under prior rules. Judge Moore held the court would not review the senate record and maintained that a majority vote, not two thirds, was necessary for confirmation. The case raised questions on expenditures and Denison's status as chairman after a certificate of office was issued. A suit to test these issues is proceeding.
